Peer 1: If I were in this situation, I would first consider the EEO guidelines that protect candidates from being unlawfully discriminated against in the hiring process. Not being in the interview myself, I would research the candidate to determine if there was a significant possibility that any of their protected characteristics played a role in the decision. I would compare my information to the candidate that was hired for the role to identify any key differences in these areas. These protected characteristics can include age, color, disability, genetic information, marital status. military status or experience, national origin, pregnancy, race, religion, or sexual orientation (Mathis, et al., 2020).
I would also explore the possibility of disparate treatment and disparate impact in this situation. Disparate treatment would likely be identified as I explore any initial unlawful discrimination of protected characteristics. Disparate impact, however, would not appear as an outwardly discriminatory act in the hiring process, so I would examine this slightly more in-depth and require more information about the candidate.

Peer 2: If I were to review a candidate that was not hired for a position that they were qualified I would first and foremost understand what the reasonings were. I would also take into consideration all the laws that the EEO has enforced and ensure that this decision is not discriminatory in anyway as the Civil rights act of 1964 protects them from doing so. There are a few steps I could take to review the decision; I would review the interview discussion and understand as to why the candidate was rejected. I would also review his resume and qualifications to see if he in fact would be a great fit for the role. To prevent this from happening, there are steps you can implement during the interviewing & hiring process; use inclusive language, implement a skill assessment, include blind hiring practices, use job-related selection criteria, gather diverse hiring teams, and offer training on EEOC policies.
These would be great tools to implement into hiring practices to ensure that the company is being mindful and following laws to avoid paying penalties.
